First Offense
BAC of 0.08 to 0.09 percent:
- Fine of $250-$400
- Up to 30 days in jail
- 90-day driver’s license suspension
- Two 6-hour classes at the intoxicated drivers resource center over two consecutive days

BAC of 0.10 percent or more:
- Fine of $300-$500
- Up to 30 days in jail
- 7-12 month driver’s license suspension
- Two 6-hour classes at the intoxicated drivers resource center over two consecutive days

- Annual surcharge penalty of $1,000 for 3 years
Second Offense
- Fine of $500-$1000
- 2-90 days in jail
- 2-year driver’s license suspension
- 48 Consecutive hours of detainment in a regional intoxicated drive resource center
- Annual surcharge penalty of $1000 for 3 years
- Installation of an ignition interlock device for 1 to 3 years after license restoration
Third Offense
- Fine of $1000
- 180 days in jail
- 10-year driver’s license suspension
- an in-patient alcoholism treatment program
- Annual surcharge penalty of $1000 for 3 years
- Fee paid to the intoxicated driver resource center as decided by the court
- Installation of an ignition interlock device for 1 to 3 years after license restoration
In addition to the above, a DWI / DUI conviction also mandates:
- $100 drunk driving enforcement fund surcharge
- $100 MVC restoration fee
- $100 intoxicated riving program fee
- $50 violent crimes compensation fund fee
- $75 safe and secure community program fee
Plus, a judge may order the revocation of the defendant’s vehicle registration.
There are increased penalties if the DUI/DWI occurs in a school zone, and for the parent/guardian of a child 17 years old or younger when the child is in the vehicle during the arrest.
