- That there was “operation of a vehicle or vessel,”
- By the defendant,
- While intoxicated, and
- With an alcohol or blood alcohol concentration at or about the statutory limit.

Since this is a criminal case, these elements must be proven beyond a reasonable doubt or the court should find you not guilty. If a prosecutor cannot establish each element beyond a reasonable doubt then the case should be dismissed and the charges dropped.
